{"id":26256,"date":"2020-10-25T22:00:02","date_gmt":"2020-10-25T22:00:02","guid":{"rendered":"https:\/\/rmolaw.com.au\/family-law-mediations-arbitrations-the-research-the-revelations\/"},"modified":"2025-02-24T05:14:16","modified_gmt":"2025-02-24T05:14:16","slug":"family-law-mediations-arbitrations-the-research-the-revelations","status":"publish","type":"post","link":"https:\/\/rmolaw.com.au\/zh\/family-law-mediations-arbitrations-the-research-the-revelations\/","title":{"rendered":"Family Law Mediations &#038; Arbitrations: The Research &#038; The Revelations"},"content":{"rendered":"<p>The <a href=\"https:\/\/aifs.gov.au\/\" target=\"_blank\" rel=\"noopener\">Australian Institute of Family Studies<\/a> regularly conducts studies to obtain information on parenting arrangements after separation.<\/p>\n<p>This article focusses on their findings from their latest study which was released in October 2019.<\/p>\n<h3>Key Findings<\/h3>\n<ul>\n<li><span style=\"font-size: 115%;\">97% of separated parents do not go to court to determine parenting arrangements.<\/span><\/li>\n<li><span style=\"font-size: 115%;\">16% of separated parents engage family dispute resolution services or lawyers to assist them to decide parenting matters.<\/span><\/li>\n<li><span style=\"font-size: 115%;\">3% of separated parents use the court as their &#8220;main pathway&#8221; to formalise parenting arrangements &#8211; these families were found to be affected by family violence, child safety concerns and other complex issues.<\/span><\/li>\n<\/ul>\n<h3>Common Parenting Arrangements<\/h3>\n<ul>\n<li><span style=\"font-size: 115%;\">Mother with majority care &#8211; 46%<\/span><\/li>\n<li><span style=\"font-size: 115%;\">Mother with sole care &#8211; 27%<\/span><\/li>\n<li><span style=\"font-size: 115%;\">Mother and father shared care &#8211; 21%<\/span><\/li>\n<li><span style=\"font-size: 115%;\">Father with majority care &#8211; 3%<\/span><\/li>\n<li><span style=\"font-size: 115%;\">Father with sole care &#8211; 2%<\/span><\/li>\n<\/ul>\n<p>The study found that it was fairly uncommon for children to have no contact with their father \u2013 9% of cases.<\/p>\n<h3>How Are Care Arrangements Determined?<\/h3>\n<ul>\n<li><span style=\"font-size: 115%;\">Discussions with other parent &#8211; 68.9%<\/span><\/li>\n<li><span style=\"font-size: 115%;\">Nothing specific- arrangements just happened &#8211; 10.4%<\/span><\/li>\n<li><span style=\"font-size: 115%;\">Counselling\/mediation\/family dispute resolution services &#8211; 9.9%<\/span><\/li>\n<li><span style=\"font-size: 115%;\">Lawyers &#8211; 5.7%<\/span><\/li>\n<li><span style=\"font-size: 115%;\">Court &#8211; 2.9%<\/span><\/li>\n<li><span style=\"font-size: 115%;\">Something else &#8211; 2.1%<\/span><\/li>\n<\/ul>\n<p>Of the 2.9% of parents who attended court for parenting arrangements, the majority had experienced family violence (physical violence &#8211; 54%, emotional abuse &#8211; 85%).<\/p>\n<p>Almost 50% of parents reported that they had concerns for safety.<\/p>\n<h3>A Cost-effective Alternative To Court<\/h3>\n<p>Save time, money and heartache with family law mediation or arbitration.<\/p>\n<p>Mediation and arbitration are two types of Alternative Dispute Resolution (\u201c<strong>ADR<\/strong>\u201d), which enables you to resolve your family law dispute without the need to have a court impose a decision.<\/p>\n<p>In most cases, the courts require separated parties to go to mediation first to resolve their disputes.<\/p>\n<h3>What Is Mediation<\/h3>\n<p>Family law mediation allows you to avoid costly court proceedings and reach an agreement quickly without a judge deciding what is best for you, your children or how to divide up the property at the end of a relationship.<\/p>\n<p>Benefits include:<\/p>\n<ul>\n<li><span style=\"font-size: 115%;\">A more cost-effective option compared to court proceedings.<\/span><\/li>\n<li><span style=\"font-size: 115%;\">Reduce the risk of smaller issues being overlooked.<\/span><\/li>\n<li><span style=\"font-size: 115%;\">Can be held face-to-face, over the phone, video conferencing or with each party in separate rooms.<\/span><\/li>\n<\/ul>\n<h3>What Is Arbitration<\/h3>\n<p>Arbitration is a way of resolving disputes outside of court.
