Family Law Mediation: An Overview

Many people worry that mediation is going to be a talk fest and a waste of money and would prefer to head straight to court. However, mediation, when done well, can be a very powerful way to resolve complex conflicts even where parties are unable to agree on anything at the outset.

Mediation is a structured negotiation process which firstly identifies the key issues where parties are unable to come to an agreement. Each issue is dealt with in order of importance in the process of developing an agreement either by way of a parenting plan or consent orders.

Our skilled family lawyers and mediators can assist families develop parenting plans and consent orders to deal with all aspects of issues which are likely to arise in the future such as:

  • Who the kids will live with and spend time with
  • Who can make long term and short term decisions about health care, schooling, changing a child’s name, applying for a passport
  • Working out a COVID-19 safety plan so kids can move between households
  • Arrangements for fly in fly out workers
  • Arrangements for holidays and special days such as religious festivals, birthdays etc.

Mediation works best where parties come together committed to reaching a solution to avoid court.

It helps to preserve relationships between the parties so they can work together in the future and look for solutions which don’t involve the court system, saving money and heartache.
