New Year, New Body Corporate Regulations

A modernised set of body corporate regulations take effect on Monday, 1 March 2021.

Working closely with stakeholders within the body corporate industry, the Palaszczuk Government expects the new regulations will be viewed favourably by body corporate operators and Queensland unit owners.

The objectives of the new body corporate regulations include:

  • streamlining and modernising body corporate procedures
  • reducing body corporate costs, and
  • enhancing protective mechanisms for unit owners.

New regulations include:

  • The ability to vote electronically and attend meetings via tele-conference or video-conference.
  • Enable the use of email and other forms of electronic communications to exchange information.
  • Updating and detailing the expectations regarding documents original owners (i.e. developers) must provide to the body corporate in order to assist with the effective governance of the scheme.
  • Assist to identify and remedy building defects more effectively by requiring a body corporate to consider motions to prepare a defect assessment report (at its second annual general meeting).
