Good Behaviour Bond For Using A Carriage Service To Menace, Harass Or Cause Offence
The Situation: We represented a mature female with a charge of using a carriage service to menace, harass or cause offence. The charges involved our client leaving a number of abusive and threatening voice messages on her ex-partner’s phone, as well as an excessive amount of calls over a two week period.
The court accepted our argument that our client’s behaviour was out of character for her, and the calls and messages occurred in context of issues surrounding parenting of children to the prior marriage.
The Result: A win for our client. We successfully convinced the court that the circumstances in this occasion were exceptional, and to impose a good behaviour bond and record no conviction, which is not the common course of Commonwealth criminal charges.
