The Right To Terminate
The Situation: Our client was intent on purchasing a property in South-East Queensland. The contract was subject to a building report being obtained by our client. Our client obtained the building report and was not satisfied with the results.
Unfortunately the building inspector had not mentioned quite a few of the unsatisfactory items in his report and the sellers maintained that the buyers were acting unreasonably and did not have the right to terminate.
The Result: A win for our client. We prepared a detailed written argument to the seller’s solicitors outlining our client’s right to terminate the contract. The seller’s solicitors eventually accepted our position and the contract was terminated, to the satisfaction of our client.
