Success Story: Avoiding Imprisonment in Serious Drug Production Case
At RMO Law, we understand that facing serious criminal charges can be overwhelming, especially when the penalties include substantial terms of imprisonment. Our dedicated legal team recently represented a client charged with multiple drug-related offences, including the production of dangerous drugs. The case involved nearly 500 cannabis plants, with an estimated street value of approximately $1.5 million, placing the matter in the higher range of severity for drug offences.
Given the nature and scale of the charges, our client faced significant legal consequences. The Prosecution sought a head sentence of 2.5 years in prison, arguing that the extent of the drug production warranted a substantial custodial penalty. However, through meticulous legal preparation, strategic negotiation, and a focus on rehabilitation, we were able to secure a far more favorable outcome.
Legal Strategy and Approach
Understanding the serious implications for our client, we took a comprehensive approach to their defence. Our first step was to negotiate with the Prosecution to reduce the period over which the drug production occurred. The Sentencing Outcome
During sentencing, the Prosecution maintained its position that a term of imprisonment was necessary, pushing for a head sentence of 2.5 years. However, through strategic advocacy, compelling submissions, and the presentation of strong mitigating factors, we were able to secure a significantly reduced sentence.
The court ultimately imposed a 12-month term of imprisonment, but wholly suspended for 12 months. This meant that our client was not required to serve any actual time in custody, allowing them to continue their rehabilitation and move forward with their life without the burden of incarceration.
