Has Your Queensland Firearms Licence Been Revoked, Expired or Suspended?

If your Queensland Firearms Licence has been revoked, suspended or expired or even your Application has been rejected, you have the right to appeal that decision.
We are Legal Experts at Understanding the Review Process
The Queensland Civil and Administrative Tribunal (QCAT) is the body responsible for reviewing decisions made by the Weapons Licensing Unit of the Queensland Police Service (QPS) under the Weapons Act 1990 (Queensland). Those reviewable decisions include:
- the refusal to grant or renew a Licence;
- the imposition or amendment of Licence conditions;
- rejection of a shooting club nomination;
- suspension of revocation of a Licence.
Prepare Your Application
- Obtain the decision letter – ensure you have the letter from QPS detailing the reasons for the decision and your review rights;
- It is very important to obtain legal advice at this stage to discuss options moving forward;
- Complete the Application Form – use Form 23 Application to Review a Decision (this is complex and requires legal advice from your RMO Lawyer otherwise QCAT will not accept the Application Form);
- Assemble supporting documents – include any relevant evidence such as character references, the proof of secure store arrangements for your weapon and documentation addressing the reasons for the decision;
- Address Concerns – if the suspension was based on specific incidents or behaviours, it is important to provide context or evidence to satisfy those concerns;
- Submit your Application – we will lodge your Application and supporting documents, which can usually be quite comprehensive and detailed directly to QCAT;
- We will then appear on your behalf at QCAT.
Be Aware of Time Limits
It is important to note that you must apply for a review within 28 days of receiving the decision letter for understanding the Tribunal’s role.
QCAT is the Ultimate Decision Maker of your Appeal
QCAT will consider factors such as these:
- Your suitability as a “fit and proper person”;
- Compliance with licensing conditions;
- Any criminal history;
- Your genuine reason for holding a weapons or firearms Licence.
It is important to note that in the case of XPR -v- Queensland Police Service – Weapons Licensing (2025) QCAT 1, the Tribunal ruled that unrecorded convictions should not impact licensing outcomes unless explicitly stated in legislation.
